Omaha Forfeiture Attorney

Seized Vehicles Assets & Cash

Law enforcement officers are profiling people and vehicles to combat drug activity.  When they stumble upon cash or other  liquid or useful assets and they believe that they are linked to drug activity, they seize those assets.  They make you do all the work to get it back.  The court will require a link between the seized property and drug activity if a timely challenge is raised by the owner.

The attorneys at Dornan, Troia, Howard, Breitkreutz, Dahlquist & Klein PC LLO have the experience needed to successfully challenge the government.  In some cases, establishing that the search was illegal is all that is needed to secure the return of the money and property.  In other cases, your attorney might have to prepare a paper trail or explanation establishing the legitimacy of the money and property.

Our office has successfully challenged the government and returned hundreds of thousands of dollars, vehicles and at least one residence to our clients.  The following is a list of property that Jason Troia has been able to return to his clients :

December 5, 2013 $29,000 in US Currency seized following a traffic stop on I-80

Can the Police Take Your Cash?

If the law enforcement officer believes that your cash is linked to drug or other criminal activity, they will likely seize the cash. The higher the amount of money, the more suspicion it will raise, and unfortunately this also means it is more likely to be seized by police or Nebraska State Patrol Officers. Our criminal defense team has experience recovering large sums of cash after it was taken by police.

Can the Police Take Money or Property Even if I’m not Charged with a Crime?

So long as the police can make some link between the property and the suspicion of a crime, they can seize your property. In cases where property has been taken and there is NOT a criminal charge filed, it can be even more difficult to get the property returned. If you have had property seized and have not yet been charged with a crime, talk to our criminal defense and forfeiture attorneys to determine the best course of action for your circumstance.
