15-YEAR LICENSE REVOCATION REPRIEVES

On April 10, 2014, LB998 was passed.  It removed the 7-year waiting period for persons who want to request an ignition interlock during their 15-year revocation of their driving privileges.  The new law also added a $100.00 application fee.  In spite of the new law, the Board of Pardons (Governor, Attorney General, and Secretary of State) has indicated that they will continue their policy of requiring a 7-7-7 standard.  They want 7 years of revocation, 7 years of clean record, and 7 years of sobriety before granting a reprieve.

MOTOR VEHICLE HOMICIDE

A motor vehicle homicide charge can be charged as a misdemeanor or felony.  Any minor traffic infraction resulting in the death of someone can be the basis for this charge.  Judges have commented that this is one of the most difficult charges to sentence someone on due to the permanency of injury and lack of any intent on the part of the defendant.  Many time the grieving family of the victim(s) show up in large numbers with large voices asking for a harsh sentence.  A defense attorney can help you in reviewing the case for possible defenses as well as present to the court all of the mitigating circumstances to help ensure that you are treated fairly.

IGNITION INTERLOCK VIOLATIONS

Depending on the circumstances, ignition interlock violations can be either a felony or misdemeanor charge.  Due to the recent popularity and acceptance of ignition interlocks, your circumstances may allow for a substantial reduction in the charge or consequences for not following through completely with the court order or conditions set by the DMV.
